Mystery Gift Legal Terms
1.- ORGANIZING COMPANY OF THE PROMOTION
The company Forsa Group LLC, with address at 4290 SW 177th Ave, Miramar, FL 33029, USA, and identified with the number 47-3966260, organizes the national raffle (hereinafter referred to as “the Promotion”), to be carried out via the Internet, exclusively for users residing in the USA and Puerto Rico, in accordance with the participation requirements set forth.
The purpose of this raffle is to reward the loyalty of the followers of the Ex-Boyfriend brand.
2.- START AND END DATE
The Promotion will begin on Friday, October 18, 2024, at 12:00 AM and will end on Friday, November 1, 2024, at 11:59 PM.
3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
The participation requirements are as follows:
• Participants must reside in the USA or Puerto Rico and be over 18 years old.
• Only participants who hold an Instagram account will be allowed to participate.
• Participants must register via the URL that will be shared through Instagram stories, in the brand’s account bio, and through ads published on the META platform.
• Participants may only enter using a single email address. If it is detected that a participant is entering with multiple email addresses, they will be disqualified.
4.- CONDITIONS OF THE PROMOTION AND PRIZES
The winner will be selected randomly through a platform on November 4, 2024. The winner will be notified on November 6, 2024, via email.
There will be 20 winners. The prize will consist of 10 exclusive VIP sets (not available for sale) and 10 'checker' style shorts. These sets are extremely exclusive, only available to celebrities, in a limited edition of just 30 units.
The prize cannot be exchanged for cash or any other prize, nor can it be altered or changed. The Company reserves the right to modify the prize if, by the time the participant is declared a winner, stock issues arise and it is not possible to award the same prize.
The winner can contact the Company within 15 days from the date the winner is announced on the brand's social profile. If no contact is made within the stipulated period, another winner will be selected.
The raffle and the awarding of the prize are subject to the applicable tax regulations.
5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any participant does not meet the requirements outlined in these rules, or if the data provided to participate is invalid, their participation will be considered null and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.
The Company reserves the right to declare the raffle void.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions considered inappropriate, offensive, insulting, or discriminatory, or that may infringe upon the rights of third parties, will not be allowed. Comments against any individual that violate the right to honor, personal and family privacy, and one's image will also not be allowed.
We will not be responsible for any damages caused by comments made by participants in the Promotion that may, at any time, offend the sensitivity of other participants.
Participation in this Promotion, as well as the publication of comments made by participants in the posts, must not violate Instagram's Community Guidelines or Instagram’s Terms of Use in any way.
If the Company discovers the use of fraudulent means to participate, such as the use of bots in the comments, the prize will not be awarded, and it will remain the property of the Company.
7.- DISCLAIMER OF LIABILITY
We are not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this Promotion, nor for the participant’s use of the prize obtained from this Promotion.
We assume no responsibility in cases of force majeure or acts of God that could prevent the Promotion from being carried out or the full or partial enjoyment of the prize.
In the event that this Promotion cannot take place due to fraud, technical errors, or any other reason beyond the Company's control, we reserve the right to cancel, modify, or suspend it, including the participation webpage.
8.- PERSONAL DATA PROTECTION
The company responsible for processing your data is Forsa Group LLC, with identification number 47-3966260 and address at 4290 SW 177th Ave, Miramar, FL 33029, USA.
In accordance with the General Data Protection Regulation, each participant, by accepting these legal terms, consents to their personal data being incorporated into a file owned by the company, with the purpose of managing the raffle, disseminating and publicizing its results, and processing the delivery of the prize.
We inform you that you can exercise your rights of access, rectification, erasure, opposition, limitation of processing, data portability, right to be forgotten, and the right not to be subject to automated decisions, by sending an email to info@ex-boyfriendbrand.com or by sending a letter to the following address: 4290 SW 177th Ave, Miramar, FL 33029, USA, in both cases attaching a copy of an identification document.
9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional terms, provided that it does not prejudice or diminish the rights of the participants in the Promotion.
The mere fact of participating in the raffle implies that the participant fully accepts the conditions of these legal terms. Likewise, participation in a raffle of this nature implies acceptance of Instagram’s social network rules, through which the raffle is carried out.
10.- APPLICABLE LAW AND JURISDICTION
These legal terms will be governed in accordance with the laws of the USA (Florida). The courts of the participant’s place of residence will have jurisdiction to resolve any claims or disputes that may arise regarding the validity, interpretation, or enforcement of these terms.
